This Privacy Policy governs the manner in which AUDIA Skincare LLC collects, uses, maintains and discloses information collected from users and customers of AUDIA Skincare. This Privacy Policy applies to all Users of AUDIA Skincare. AUDIA Skincare Terms of Use are incorporated by reference into this Privacy Policy.

Consent

By using, visiting, or browsing AUDIA Skincare website (www.audiaskincare.com), you accept and agree to our Privacy Policy and consent to the collection and use of your personal information. When you use AUDIA Skincare, you may send messages and contact our beauty professionals.

Embedded content from other websites

Listings on this Site may include embedded content (e.g., videos, images, articles, etc.). Embedded content from other websites behaves in the exact same way as if the visitor has visited the other website. These websites may collect data about you, use cookies, embed additional third-party tracking, and monitor your interaction with that embedded content, including tracing your interaction with the embedded content if you have an account and are logged in to that website. If you upload images to the Site, you should avoid uploading images with embedded location data (EXIF GPS) included. Users of the Site can download and extract any location data from images on the Site.

The types of information we collect

We may collect non-personal identification information about Users whenever they interact with the Site. Non-personal identification information that helps us to understand who is using our services and how we can improve them may include:

  • Domain name.

We may collect personal identification information from users when you register with AUDIA Skincare and in connection with other activities, services, features or resources we make available. Users can always refuse to supply personal identification information, except that it may prevent them from engaging in certain Site related activities.

Your online profile is only viewable by you and AUDIA Skincare administrators. As AUDIA Skincare is designed to enable communications between Users, your full name and email address will be visible to the Member you are contacting when you communicate through the contact form on Site.

Information that personally identifies you such as:

  • Contact information that allows us to communicate with you, such as your name, email address(es), telephone numbers, profession, home or building addresses, or other addresses where you receive communications.
  • Financial and transaction data, such as encrypted credit card information, payment information and shipping information.

We do not collect any types of Sensitive Data from our users. Sensitive Data includes any personally identifiable information pertaining to: race or ethnic origin, political opinions, religious or philosophical beliefs, trade union userships, genetic or biometric data, health or mortality, and sex life or sexual orientation. Please immediately notify us if you have accidentally submitted any Sensitive Data and we shall promptly remove such information.

How we use collected information

AUDIA Skincare may collect and use Users personal information for the following purposes:

  • To improve customer service. Information you provide helps us respond to your customer service requests and support needs more efficiently.
  • To send advertising and marketing emails. We may use the email address to send user information and updates pertaining to their order. It may also be used to respond to your inquiries, questions, and/or other requests.
  • To send intermittent emails. Users will receive emails that may include company news, updates, related product or service information, etc.

How we protect your information

AUDIA Skincare takes appropriate precautions to protect our users’ information. Your account information is located on a secured server behind a firewall. We adopt appropriate data collection, storage and processing practices and security measures to protect against unauthorized access, alteration, disclosure or destruction of your personal information, username, password, transaction information and data stored on our Site. Because email and instant messaging are not recognized as secure communications, we request that you not send private information to us by email or instant messaging services. You may access your personal information by making a written request at our address listed below. AUDIA Skincare protects your information by taking reasonable steps to secure it against unauthorized access. We do this through encryption, physical administration by our staff users, and electronic measures.

Although we have implemented commercially reasonable precautions to protect the information we collect from loss, misuse, and unauthorized access, disclosure, alteration, and destruction, please be aware that despite our best efforts, no data security measures can guarantee 100% security. You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised passwords or for any activity on your account via unauthorized password activity.

Payment

If you choose to sign up for a paid Usership, payments are exclusively processed through Stripe. If you provide us with your financial or any other personal information, the information is encrypted using industry standard protections. Please refer to Stripe’s Privacy Policy  and other terms and conditions by visiting https://www.stripe.com for information regarding their own security protections and use of your personal information. No payment information is stored on our Site after your order has been processed.

In particular, remember that certain providers may be located in or have facilities that are located in a different jurisdiction than either you or us. So, if you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located. Once you leave our Site or are redirected to a third-party website or application, you are no longer governed by this Privacy Policy or our Terms of Use.

Sharing your personal information

We share your information with third parties only in limited circumstances where we believe such sharing is

  1. Legally required or,
  2. Permitted by you.

For example:

  • We may be required to disclose user information pursuant to lawful requests, such as subpoenas or court orders, or in compliance with applicable laws. We do not reveal information until we have a good faith belief that an information request by law enforcement or private litigants meets applicable legal standards. Additionally, we may share account or other information when we believe it is necessary to comply with law, to protect our interests or property, to prevent fraud or other illegal activity perpetrated through the AUDIA Skincare service or using AUDIA Skincare name, or to prevent imminent bodily harm. This may include sharing information with other companies, lawyers, agents or government agencies.
  • If the ownership of all or substantially all of AUDIA Skincare business, or individual business units owned by AUDIA Skincare were to change, your personal information may be transferred to the new owner so the service can continue operations. In any such transfer of information, your user information would remain subject to the promises made in any pre-existing Privacy Policy.
    We will not sell, trade, or rent your personally identifiable information to others. However, we do provide some of our services through contractual arrangements made with affiliates, service providers, partners and other third parties (“Service Partners”). Our Service Partners include Constant Contact and Stripe. We may choose to provide your email address and IP address on file to Constant Contact to send transactional and bulk newsletter emails for marketing. If you purchase any goods, Stripe will receive and process all payment and shipping information. We and our Service Partners may need to use some personal information in order to perform tasks between our respective sites, or to deliver services to you.

Children

You must be 18 years of age or older to register an account with AUDIA Skincare.  AUDIA Skincare does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 18, please do not attempt to register for AUDIA Skincare, make any purchases or send any information about yourself to us, including your name, address, telephone number, or email address without the supervision and consent of a parent or guardian. No one under age 13 may provide any personal information to or on AUDIA Skincare. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. Cookies and Other Tracking Mechanisms

AUDIA Skincare uses cookies and other tracking mechanisms to track information about your use of our Site. We may combine this information with other personal information we collect from you.

Cookies: Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser for record-keeping purposes. Some cookies allow us to make it easier for you to navigate our Site, while others are used to enable a faster check out process or to allow us to track your activities at our Site. There are two types of cookies we use: session and persistent cookies.

Clear GIFs, pixel tags and other technologies: Clear GIFs are tiny graphics with a unique identifier, similar in function to cookies. In contrast to cookies, which are stored on your computer’s hard drive, clear GIFs are embedded invisibly on web pages. We may use clear GIFs, including Facebook Pixel, (a.k.a. web beacons, web bugs or pixel tags), in connection with our Site to, among other things, track the activities of Site visitors, help us manage content, and compile statistics about Site usage. We and our third-party service providers also use clear GIFs in HTML emails to our customers, to help us track email response rates, identify when our emails are viewed, and track whether our emails are forwarded.

AUDIA Skincare may contain links to other websites. We are not responsible for the privacy practices of other websites. We encourage our Users to be aware when they leave our Site to read the privacy statements of each and every web site that collects personally identifiable information. This Privacy Policy applies solely to information collected by AUDIA Skincare.

Product Availability

Although availability may be indicated on our Site, we cannot guarantee product availability. We reserve the right, without liability or prior notice, to revise, discontinue or cease to make available any or all products.

Third Party Analytics

We use Google Analytics to evaluate usage of our Site. We also may use other analytic means to evaluate our Site in the future. We use these tools to help us improve our Site, performance and Member experiences. These entities may use cookies and other tracking technologies to perform their services. We do not share your personal information with these third parties.

Changing or Removing Information

AUDIA Skincare Users may modify or delete any of their profile information at any time by contacting us directly at [email protected]. Information will be updated immediately. Removed information may persist in backup copies for a reasonable period but will not be generally available to users of AUDIA Skincare.

Control Over Your Personal Information

If you want to delete your account or have other questions or requests, please contact us at [email protected] .

While we can assist you in many ways, we may not always be able to delete records of past interactions and transactions as required by applicable law. We will retain your information for as long as your account is active or as needed to provide you services and to maintain a record of your transactions. Once your account has been deleted, we may no longer retain any of your personal information unless required by applicable law, this does not include any data we are obliged to keep for administrative, legal, or security purposes.

Your personal information may be removed or destroyed from our servers where possible, and it will never be sold or distributed without your permission.

EU Residents (GDPR)

AUDIA Skincare has implemented technical and organizational measures with respect to processing personal information from European Union individuals for purposes of the EU General Data Protection Regulation (“GDPR”). Upon request, we will provide you with information as to whether and what personal data we store in relation to you. Should your personal data be incorrect, you may request to have it rectified. You may also revoke your consent to use your personal data in the future, in whole or in part, or request deletion of your personal data. International Data Transfer

AUDIA Skincare is a United States company. If you are located outside the United States and choose to provide information to us, AUDIA Skincare transfers and stores personal information to the United States for processing. The U.S. may not have the same data protection laws as the country in which you initially provided the information. When we transfer your information to the U.S., we will protect it as described in this Privacy Policy. By visiting the Site, or providing AUDIA Skincare with any information, you fully understand and unambiguously consent to this transfer, processing and storage of your information in the United States.

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. Unfortunately, the transmission of information via the internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to our Site; any transmission is at your own risk. Once we have received your information, we will use strict procedures and security features in an effort to prevent loss, theft and unauthorized access, use and disclosure.

Opting Out of Emails

We may send periodic promotional or informational emails to you. Individuals who wish to unsubscribe from our email list may do by clicking on the ‘Unsubscribe’ link at the bottom of any received email. Please note that it may take up to 10 business days for us to process opt-out requests. If you opt-out of receiving emails about recommendations or other information we think may interest you, we may still send you emails about your any purchases or requests you have made or received from us.

California Residents: California Consumer Protection Act (“CCPA”)

The California Consumer Privacy Act (CCPA) provides consumers who are residents of the State of California with specific rights related to their personal information (which includes Personally Identifiable Information), subject to certain exceptions. It also requires us to disclose the information we collect, the purposes for which we collect it, and what we share and disclose.

Right to Opt-Out (“Do Not Sell”)

You have the right to tell us not to disclose or transfer your personal information to a third party in exchange for something of value. The CCPA refers to this as your right to say “Do Not Sell” my personal information.  If you opt out of disclosure or transfer of your personal information, you may later opt-in again to having your personal information move more freely.

Exercising Your Rights

Right to Know and Right to Delete

You may ask us for the personal information we have about you, or ask us to delete your personal information, by sending an email to [email protected] from your registered email address with us.

When you make a request, we will verify your identity by sending you an email and asking you to respond. 

If you ask what personal information, we have received from you, and we cannot verify your identity, or if providing the information, you have requested creates a security risk, we will give you a general description of the type of personal information we have about you.

If you ask us to delete your personal information, and we can’t verify your identity and confirm that you made the request, we will not be able to honor it.  Generally, though, if we can confirm your identity and your request, we will delete, de-identify, or aggregate your personal information so it can no longer be associated with you.  There are some reasons that the law may require or permit us to keep your personal information, however.

Authorized Agents

If you are an authorized agent, you must make your request by emailing us at [email protected] and put the words “CCPA Requests, Authorized Agents” in the subject field. You also need to attach to your email proof that you are registered with the Attorney General, as required by law, and proof you have written authority to act for the consumer.  You shall also provide the email address of the consumer you are representing so we can verify their identity or provide documentation that you have power of attorney for the consumer pursuant to Probate Code sections 4000-4465.  We will not be able to honor requests without sufficient documentation that you are authorized to represent the consumer.

Requests made on behalf of a “Household”

If you would like to request personal information about your household, you may make your request by emailing us at [email protected] and putting the words “CCPA Household Request” in the subject field of the email. We will need to verify the users of the household, and in some cases, if a request raises security concerns for any household member, we may not be able to honor the request.

Financial Incentives

We do not offer any financial incentives for consumers to take any action or make any choices in using our services.

Non-Discrimination

We will not discriminate against you for exercising any of the rights described in this Privacy Policy. Specifically, we will not deny you goods or services or charge you different prices or rates for goods or services, including through the use of discounts or other benefits, or by imposing penalties.

California “Shine the Light” Law

Residents of the State of California may request a list of all third parties to which we have disclosed certain information during the preceding year for those third parties’ direct marketing purposes.

California “Eraser” Law

If you are a California resident under the age of 18, and a user of the Site where this policy is posted, you may request removal of content or information you have publicly posted. Please be aware that such a request does not ensure complete removal from the Internet of the content or information you posted, and there may be circumstances in which the law does not require or allow removal.

Exercising these Rights

For all requests under the “Shine the Light” or “Eraser” Law, you must put the words “Your California Privacy Rights Shine the Light/Eraser Law” in the subject field of an email to [email protected]. AUDIA Skincare reserves the right to change this Privacy Policy from time to time as it sees fit and your continued use of the Service will signify your acceptance of any adjustment to this Privacy Policy. If there are any changes to our Privacy Policy, we will announce that these changes have been made on our home page and on other key pages on our Site. If there are any changes in how we use our customers’ personal information, notification by e-mail will be made to those affected by this change. Any changes to our Privacy Policy will be posted on our Site 30 days prior to these changes taking place. You are therefore advised to re-read this statement on a regular basis.
